MINUTES OF THE PUBLIC MEETING OF JANUARY 10TH, 2006

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Philip Lindquist, Chairman, in the Conservation Office at the Town Hall.

Appointment

7:30 PM Appointment with Peter Dillon of The Chilmark Company to discuss a water main replacement on Main Street for Brookside II.

Ms. Delaney made comments regarding the difficulty.  It initiated when the contractors unknowingly used a plan that had an inaccurate wetland line while installing a water main on Main Street for a new subdivision.  Consequently, the work that they performed was in the buffer zone within 30’ of a wetland.  As mitigation, Mr. Dillon submitted a letter from Chilmark offering in writing to install a silt fence, clean out the accumulated sediment, trash, etc. and loam and seed the slope in the spring.  Ms. Delaney recommended approval for work to commence under the previous filing.  (DEP #SE175-441)

Public Hearings

7:45 PM  Notice of Intent for the construction of a 16’x32’ addition and a 12’x20’ sunroom
and a septic system upgrade at 52 Richard Road, Assessors Map 80, Lot 54 for Paul Anderson represented by Ross Engineering Co., 683 Main St., Norwell, MA  (New Hearing)  (DEP #175-0486)

David Harris read the Public Hearing Notice and the abutters were verified.  Greg Tansey of Ross Engineering presented a revised plan and made the presentation.   The proposal calls for the removal of the existing leaching field adjacent to the wetland and the installation of a new jet system treatment plant approved by the Board of Health in a further location on the lot.  The proposal also calls for the construction of an addition and a sunroom.   Ms. Delaney commented that the addition would not meet the 50-foot no build setback requirement.  However, since the house was built in 1969 and the applicant was asking for a hardship, Ms. Delaney suggested that the Commission approve the variance request in anticipation of mitigation in the form of drywells and plantings along the wetland line to be shown on the as-built.

8:00 PM Continued  Request to Amend an Order of Conditions to allow a modification to relocate garages at 255 Rear Liberty Street, Assessors Map 82, Lot 6-1 for Dennis Leary, Trustee for Hudson Park Associates, N.T., 2 Columbia Rd., Pembroke, MA  02359   (DEP #175-0433)  - Continued to January 24th at 8:15 PM per request of applicant


8:15 PM Appointment with Bob Gosselin of GosCon represented by Grady Engineering to discuss Certificate of Compliance requests for Litchfield Lane and Proudfoot Way.

Kevin Grady of Grady Engineering attended the meeting relating to the four (4) Certificate of Compliance Requests made for Litchfield Lane and Proudfoot Way by the developer, Bob Gosselin.  A lot of correspondence had transpired between the agent and Mr. Gosselin/Grady Engineering over the last several months with regard to unresolved conditions at each of the properties.  Ms. Delaney pointed out that although there was an extensive file and a record of the hearings with Mr. Gosselin, an Order of Conditions was never issued for the subdivision itself.  Mr. Grady suggested that Mr. Gosselin had made a good faith effort to rectify the issues as per conversations with the Conservation Commission.  The meeting resulted in the following decisions per each COC Request:

100 Litchfield Lane, Lot 8 (DEP #175-409) – Mr. Grady said that the permanent setback markers had been installed as required, but the silt fence had not been removed.  The owners, Tom and Nancy Rogers attended the meeting and voiced their frustration over the detention basin on their lot that they feel doesn’t drain properly.  Also, their haybales and silt fence were not removed and are unsightly.  Ms. Delaney wanted a corrected as-built to show all relevant structures on the plan.  Mr. Lindquist said that the Planning Board was working with Mr. Gosselin to work out the detention basin issues.  The Commission denied a Certificate Compliance Request at this time.

92 Litchfield Lane, Lot 7 (DEP #175-391) – Mr. Grady said the permanent setback markers had been installed and the silt fence was removed.  Ms. Nehiley had received a phone call from the owners, the Wynne’s, who were satisfied that all had been completed.

19 Proudfoot Way, Lot 5 (DEP #175-387) -  Mr. Grady said that Mr. Gosselin is seeking relief from the placement of permanent setback markers in three locations.   Ms. Delaney stated that the driveway had encroached into the 50-foot no-disturb setback, which was more of a reason to install markers for future reference. This Request was also denied.

5 Proudfoot Way, Lot 6 (DEP #175-410) – Ms. Delaney had asked for and not yet received a revised plan that shows a stone wall that was installed instead of rip-rap.   Certificate of Compliance denied pending revised as-built.

Mr. Grady was asked to advise Mr. Gosselin of the ongoing issues, and notify the Commission when all that was discussed at the meeting is completed and a final inspection will be conducted.  Also, the Commission deemed that additional site visit fees shall be assessed.

8:30 PM  Continued Notice of Intent for a revised proposal for the construction of eight (8) single-bedroom condominium units with parking and septic within 100 feet of a bordering vegetated wetland at 1139 Main St., Assessor’s Map 43, Lots 36A & B and 36.  A portion of the construction falls within the 100-foot inner riparian zone. Proposal includes clean up of existing construction debris and soils on Lot 36.   Applicant:   Demco Enterprises, Inc., 31 Perkins Street, Bridgewater, MA  02324 represented by Land Planning, Inc.. (DEP #175-0460) – to be continued to an unspecified date after ZBA hearing per request of Bob Crowell of Land Planning, Inc..

Letter (12/8/05) from Chris Pongratz regarding the easement and access road at 22 Industrial Blvd. – This was determined to be a Water Department issue.

Enforcement Issues

261 Maquan Street – stockpiling of woodchips in wetland, Ms. Delaney will send letter
889 Winter Street –  haybales eroded, Ms. Delaney will send letter

WHRHS – Enforcement Order/penalties, Stonebridge Commons/penalties, 78 Forest Trail/ Enforcement Order/penalties

Above mentioned properties were discussed.  The Commission decided to issue penalties to accompany the Enforcement Orders previously issued.  The maximum fine is $300.00 per day per violation.  At this time, the Commission determined to send a total of a $300.00 fine to each contractor for all of the violations at each site.
